A January 24, 2009 Seattle Times article, "Lawmaker asks Microsoft about keeping American workers," describes Iowa Senator Chuck Grassley’s letter to Microsoft Chief Executive Officer Steve Ballmer in which Sen. Grassley questions Microsoft’s layoffs and insists that Microsoft “has a moral obligation” to layoff H-1B workers before laying off anyone else. The Seattle Times article quotes Mr. Weber on his insights into the legal complexities of implementing Senator Grassley’s suggestion in light of long-standing federal laws against discrimination on the basis of national origin, legal immigration status, etc. Numerous media outlets have also quoted Mr. Weber on this issue. Cletus M. Weber, co-founder of Peng & Weber, PLLC, recently served as the moderator of a two-person panel at the 2009 Northwest Regional Immigration Conference of the American Immigration Lawyers Association (AILA), in Seattle, Washington. The panel was part of the “Government Agencies” track and was devoted specifically to issues at the U.S. Citizenship and Immigration Service’s (CIS’s) California Service Center. (Among other petitions and applications, the California Service Center processes all cap-exempt H-1B petitions from throughout the United States.) The government panelist was Mr. Kurt Gooselaw, Assistant Director of the CSC and the head of CSC’s Division II, which handles nonimmigrant petitions that are not premium processed. Mr. Weber and Mr. Gooselaw discussed H-1B cap-exemption issues, L-1B specialized knowledge petitions, and other petitions and also took questions from immigration attorneys in the audience. Feb. 2009 Cletus M. Weber, co-founder of Peng & Weber, recently completed the final draft of a book chapter for AILA's nationally distributed book on resolving immigration issues for physicians. Mr. Weber's book chapter, entitled "For H-1B Cap Exemptions, 'Related or Affiliated' is Pretty Close to Where It's 'at'," describes the challenges facing physicians (and others) who are employed "at" institutions of higher education, nonprofit research organizations, governmental research organizations, and especially nonprofit entities related to or affiliated with institutions of higher education. Mr. Weber also provides guidance for employers and their immigration counsel on how to address these challenges. An article in HR Magazine, "Unmasking Illegal Workers," (Dec. 1, 2007) describes the difficulties facing Human Resources managers and other company officials who discover that one or more of their employees--sometimes one of their most senior staff--is an undocumented worker. The ethical and business challenges are considerable, and Mr. Weber is quoted on the procedures that employers must follow when first hiring an employee and what the options and challenges are when learning of the undocumented status. The Mercer Island Reporter published an editorial by Peng & Weber, PLLC co-founders, Elizabeth Peng and Cletus M. Weber regarding comprehensive immigration reform. The editorial of Ms. Peng and Mr. Weber, "Immigration reform must reflect economic realities, common sense," argues that comprehensive immigration reform should not be created through knee-jerk politics, but should instead be carefully thought out and be done in a way that reflects economic realities, such as global competition, and common sense. May 19, 2005 Cletus M. Weber was
elected the Washington State Chapter Chair of the
American Immigration Lawyers Association
(AILA) on May 19, 2005. Mr. Weber has served on the Executive Committee of the
Washington
State Chapter of AILA since 2001. As a Chapter Chair, Mr. Weber also serves as a member of
the National Board of Governors of AILA. Mr. Weber will work to enhance transparency between
government agencies and the Association, and to support the goals and mission of AILA.

on immigration issues, published an article written by Cletus Weber
on "Immigration Without Labor Certification: When and Why to File an EB-1 or NIW
Petition " on May 1, 2004. The article compares and
contrasts each of the employment-based, first-preference (EB-1)
categories, including Aliens of Extraordinary Ability (EB-1A),
Outstanding Professors or Researchers (EB-1B), and Multinational
Executives and Managers (EB-1C) as well as the employment-based,
second-preference (EB-2) category of National Interest Waivers (NIW).

Jun. 1, 2003 Elizabeth Peng and Cletus Weber Admitted to Practice Before the U.S. Supreme Court Elizabeth Peng and Cletus Weber, founding partners of Peng & Weber, were sworn in to practice law before the U.S. Supreme Court in Washington, DC, qualifying them to argue cases before the nation's highest Court. The motion for admission to the Court was made by Stephen McAllister, Dean of the University of Kansas School of Law. Dean McAllister and Ms. Peng are both 1988 graduates of the University of Kansas School of Law and interned at the same law firm in Washington, DC in the late 1980s. Dean McAllister also clerked for former U.S. Supreme Justice Byron White and current Justice Clarence Thomas. The swearing-in ceremony was followed by a private reception at the Supreme Court, at which Ms. Peng, Mr. Weber, and friends from the University of Kansas School of Law had a chance to chat briefly with Supreme Court Justices Clarence Thomas and Ruth Bader Ginsburg and former U.S. Senate Majority Leader Bob Dole. Feb.20, 2003 Cletus Weber Speaks at 2003 AILA NW Regional Immigration Seminar Cletus Weber, a founding partner of Peng & Weber, served as discussion leader on two panels at the 2003 Northwest Regional Immigration Conference. The conference was held in Portland, Oregon on February 20-21, 2003, and was jointly sponsored by the Washington and Oregon Chapters of the American Immigration Lawyers Association. The first panel was on "Alternatives to Labor Certification" and covered the achievement-based immigration categories of Aliens of Extraordinary Ability, Outstanding Professors or Researchers, and National Interest Waivers. A representative from the Immigration Service's Nebraska Service Center was also on this panel. This provided a good opportunity to examine these issues not only from the perspective of a lawyer who has practiced in this area for more than 10 years, but also from the perspective of the Immigration Service itself. (The Nebraska Service Center is where these petitions are filed if the petitioner is located in the north half of the United States from Washington state to Ohio.) The other panel was on "Law Office Management and Technology," a topic on which Mr. Weber has spoken at national, regional, and local conferences. Jan. 31, 2003 Cletus Weber Invited Speaker at AILA 2003 Midyear CLE Conference in Cancun, Mexico The American Immigration Lawyers Association (AILA) invited Cletus Weber, a founding partner of Peng & Weber, to speak on "The Labor Certification Process and Other Options" for AILA's national 2003 Midyear CLE Conference. The topic of the conference was "Business Immigration: The Challenges of Practicing In Today's Recessionary Environment." The conference was held in Cancun, Mexico on January 31, 2003. The paper Mr. Weber presented (C. Weber & R. Wada, "National Interest Waivers - a Practice Update") was subsequently published by AILA as a book chapter in Homeland Security, Business Immigration: The Challenges of Practicing In Today's Recessionary Environment (AILA 2003). A previous version of Mr. Weber's paper was published in Bender's Immigration Bulletin, a national immigration law publication of Matthew Bender & Co., Inc., which is now part of LexisNexis™.
